This Notice describes how medical and behavioral health information about your child (“Protected Health Information” or PHI) may be used and disclosed by Better Days ABA, and how you can access this information. Please review it carefully.
We are required by law to maintain the privacy of PHI and provide you with this notice.
We must follow the terms of this notice while it is in effect.
We reserve the right to change the terms of this notice at any time, as permitted by law. Any changes will apply to PHI we already have.
Updated notices will be available upon request and on our website.
We may use and disclose PHI without your written authorization for the following purposes:
Providing ABA therapy and related behavioral health services.
Coordinating care with other healthcare providers or schools when necessary for your child’s treatment.
Billing insurance or Medicaid for services rendered.
Verifying coverage or obtaining prior authorization.
Conducting quality improvement, training, and administrative activities.
Auditing, compliance, and licensing requirements.
When disclosure is required by federal, state, or local law.
Reporting child abuse, neglect, or threats to safety, as required by law.
Uses or disclosures of PHI for purposes other than treatment, payment, or healthcare operations require your written authorization, such as:
Marketing purposes
Sale of PHI
Certain research purposes
You may revoke your authorization at any time in writing, except to the extent we have already relied on it.
You have the following rights regarding your child’s PHI:
Right to Inspect and Copy – You may request access to your child’s records.
Right to Amend – You may request corrections to your child’s PHI if you believe it is inaccurate.
Right to an Accounting of Disclosures – You may request a list of certain disclosures we have made.
Right to Request Restrictions – You may request limits on how we use or share PHI.
Right to Confidential Communications – You may request alternative ways to receive communications (phone, email, mail).
Right to Receive a Paper Copy of This Notice – Even if you agreed to electronic delivery.
If you believe your privacy rights have been violated, you may file a complaint with Better Days ABA or the U.S. Department of Health and Human Services (HHS).
Filing a complaint will not affect the care provided to your child.
